Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using “PicoCraft” (the “App”), a game for iPhone and iPad provided by Hachiware, LLC. (“we” or “us”). Anyone who uses the App (a “User”) must agree to these Terms before using it.

Article 1 (Application)

These Terms apply to all matters relating to the use of the App between Users and us.

Article 2 (Purchase)

The App is sold for a fee. Purchases and payments are made through the App Store and are subject to the terms set by Apple. Due to the nature of digital content, we cannot accept returns or cancellations after purchase. Refunds are subject to Apple’s refund policy.

Article 3 (Prohibited Conduct)

When using the App, Users must not:

  1. Violate laws or public order and morals
  2. Modify or analyze (including reverse engineering) the App’s program
  3. Tamper with in-game data by improper means
  4. Infringe the rights of us or any third party
  5. Do anything else we deem inappropriate

Article 4 (Intellectual Property)

Copyrights and other intellectual property rights in the App belong to us or their rightful owners.

Article 5 (Changes to or Suspension of the Service)

We may change the content of the App or stop providing it without prior notice to Users.

Article 6 (Disclaimer)

  1. We do not guarantee that the App is free of defects in fact or in law.
  2. For damage Users suffer from using the App that is caused by our negligence (excluding gross negligence), the amount we pay is limited to the price the User paid when purchasing the App. This limit does not apply to damage caused by our intent or gross negligence.

Article 7 (Changes to These Terms)

  1. We may change these Terms when the change is in the general interest of Users, or when the change does not go against the purpose of these Terms and is reasonable in light of the need for the change, the appropriateness of the changed content, and other circumstances.
  2. When we change these Terms, we will post the changed content and the date it takes effect on this page before that date.

Article 8 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the location of our head office.
